Fresh execution petition received by way of assignment through
e-filing module. It be checked and registered.
Present: Ms. Niharika Pandey, Ld. Counsel for DH.
Hard copy of the present execution petition has been filed
on behalf of the DH. Same is taken on record.
Perusal of the record denotes that the DH has not filed the
certified copy of the impugned order of which execution is sought and
only the internet generated copy of the said order has been filed by the
DH.
Application has been filed on behalf of DH seeking
exemption from filing the certified copy of the award/order. Same is
taken on record.
Ld. Counsel for the DH submits that the concerned registry
is not accepting the applications for certified copies of order qua
similarly situated workmen and therefore the certified copy of the
impugned order could not be filed by the DH. Ld. Counsel for the DH
further submits that a writ petition bearing no. 11188/2023 before the
Hon'ble High Court of Delhi for redressal of the said grievance is
pending adjudication.

Ld. Counsel for the DH undertakes to file the certified
copy of the impugned order as and when the same is made available by
the concerned registry.
In view of the submissions made and in the interest of
justice, the application filed by DH is allowed with the direction to DH
to place on record the certified copy of impugned award/order as soon as
the same is made available.
Submissions heard.
Issue notice to the JD on filing of PF within 15 days.
Put up for further proceedings on 16.07.2024.
