An application u/s 151 CPC has been moved by
plaintiff seeking waiver of cost on the ground that the counsel
not appear on last two dates of hearing due to engagement in
other courts. However, in the opinion of this court, the same does
not amount to any justifiable reason and hence, the application
stands dismissed.
Let cost be paid to the defendant before NDOH
positively.
Let WS be filed, within 30 days from today with
advance copy to opposite side against receipt, after which,
replication, if any, be filed on the NDOH with advance copy to
opposite side against receipt.
At this stage, the parties have submitted that there
are chances of settlement in the present matter.
Accordingly, the present suit is hereby referred to
mediation centre for exploring the chances of settlement and
parties are directed to appear at Mediation Cell, Central, THC on
21.11.2023 at 2:00pm.

Be put up awaiting mediation report on 23.12.2023.
Any party failing to appear in mediation would be
burdened with costs.
