Defendant has been served through publication vide
publication dated 06.09.2024. since, the stipulated time period for
filing WS has expired, defence of the defendant is struck off and
defendant is proceeded exparte.
Ld. Counsel for the plaintiff has filed application for
substitution of AR and application for filing additional documents.
Ld. Counsel for the plaintiff has filed application for
substitution of AR and application for filing additional documents.
Ld. counsel has prayed to bring on record document
of statement of account.
Since, the matter is at its initial stage and evidence is
to be led, in view of the contents of the application, application
under Order 7 Rule 14 CPC stands allowed.
Ld. Counsel for the plaintiff has also filed an
application for substitution of AR alongwith copy of authority
letter.
The application being formal in nature is hereby
allowed and Sh. J. K. Jha is substituted as new AR of the plaintiff
in place of earlier AR. The application is disposed of accordingly.
