At this stage, it is submitted by Ld. counsel for
defendant no. 2 that defendant no. 2 may be deleted from array of
parties.
Perusal of record shows that present recovery suit
has been filed by the plaintiff on the ground that defendant no. 1
has obtained personal loan from the plaintiff. It appears from the
pleadings that defendant no. 2 is neither the borrower nor the
guarantor qua the said loan and no relief can be claimed against
defendant no. 2. Accordingly, defendant no. 2 is deleted from
array of parties being neither necessary nor proper party in the
present matter.
Steps not taken for service of defendant no. 1. Same
has been the position since last several dates.
At this stage, it is submitted by Ld. proxy Counsel
for the plaintiff that some time may be given to file correct/fresh
address of defendant no. 1.
In the interest of justice, one last and final
opportunity is granted to plaintiff to pursue the present matter.
Put up for purpose fixed on 05.08.2024.
