1. Today, an application under Order 5 Rule 20 R/w Section
151 CPC alongwith affidavit has been filed.
2. Arguments heard. Record perused.
3. Ld. Counsel for the plaintiff submits that the plaintiff does
not have any alternate address of the defendant. It is pertinent to
mention here that efforts have been made for the service of the
summons which were received back unserved. In view of the
reports on record of the court file, this court deems it appropriate to
get the defendant served through publication in the daily
newspaper circulated in the locality where the defendant was last
known to have resided or voluntarily carried on business or
worked for gain. Accordingly, the application stands allowed.
Application disposed of accordingly.
4. Let publication be issued against defendant in the
newspaper circulated in the locality as per rules where the
defendant was last known to have resided, or voluntarily carried on
business or worked for gain on filing of PF and depositing the
publication charges etc. by the plaintiff, returnable for 09.10.2024.
5. At request, dasti publication be given if desired.
6. List the matter for 09.10.2024.
