Today, an application under Order VII Rule 14 of CPC has
been filed on behalf of plaintiff to bring on record in support of the loan taken
by defendant No.1. Copy supplied.
It is submitted by Ld. counsel for defendant No.2 that as
already stated on the last date of hearing, the defendant No.1 is an employee
of NDMC which has its head office at Palika Bazar and MCD i.e. defendant
No.2 has no connection with the said department.
On the last date, Ld. Counsel for plaintiff had sought time to
obtain instructions from the plaintiff bank but today, an adjournment is sought
due to personal difficulty of the main counsel. Heard. Allowed.
The main counsel for plaintiff and appropriate official of the
plaintiff bank (not below the rank of Manager) who is apprised of the facts of
the present case, are directed to appear on the next date of hearing.
