At 11:44 AM
Present: Sh. Ram Raghvendra Kumar, Ld. Counsel for plaintiff with
proposed AR.
On the last date of hearing, an application for substitution of AR
has been moved on behalf of plaintiff along with photocopy of Board Resolution
in favour of proposed AR.
Heard. Perused.
Since the application is formal in nature, therefore, allowed and
Sh. Jibachh Kumar Jha is taken as new AR of the plaintiff bank in place of
earlier AR. Application disposed off accordingly.
Now application for waiver of cost moved on behalf of plaintiff
on the last date of hearing is taken up.
Perusal of record shows that a cost of Rs,5,000/- was imposed
upon the plaintiff on 29.07.2024 as neither the manager of plaintiff appeared on
the said date nor the proxy counsel for plaintiff was aware if the defendant
no.2/MCD was deleted from the array of parties or not.
Perusal of order dated 29.07.2024 shows that the said cost was
imposed due to negligence on the part of the plaintiff and no cogent ground has
been mentioned in the application for waiver of said cost. Accordingly, court is
-- 1 of 2 --
not inclined to waive of said cost. Let the same be deposited in DLSA (central)
and receipt be filed within three days from today failing which further cost shall
be imposed upon the plaintiff. Application disposed off accordingly.
Plaintiff is directed to file amended memo of parties in terms of
order dated 29.07.2024 on the next date of hearing.
Plaintiff is also directed to clarify as to the territorial jurisdiction
of this court.
