Sh. Varun Sharma, ld. counsel for defendant No.2/MCD with

None for defendant No.1.
On the last date of haring, defendant No.1 had appeared and
stated that indeed he had taken a loan from the plaintiff bank but he was at
variance with the balance amount. However, none is present on behalf of
defendant No.1 neither any written statement has been filed. The stipulated
period provided under CPC for filing the written statement has already lapsed.
Therefore, right of defendant No.1 to file written statement stands closed.
It is submitted on behalf of defendant No.2 that without the
payslip/ ID card of defendant No.1, the defendant No.2 cannot trace his
particulars and therefore, no written statement could be filed in the present suit
on behalf of defendant No.2.
Heard.
Plaintiff is directed to supply a copy of salary slip and/or
employee ID card of defendant No.1 to defendant No.2 within ten days from
today against due acknowledgement. Let written statement be filed on behalf
of defendant No.2 within 30 days of the said date.
Put up for further proceedings, on 03.01.2024.
