Order Details: COPY OF JUDICIAL PROCEEDINGS Pdf Text: 3 ESIC No. 2/23 MS VAISHNO SECURITY AND PLACEMENT SERVICES REGDVs. EMPLOYEES STATE INSURANCE CORPORATION 06.03.2024 Present : Sh. Vinod Kataria, Ld. Counsel for the petitioner. Sh. Swarnjeet Singh, Ld. Counsel for the respondent alongwith Sh. Vimal Gupta, SSO. More time sought to file reply in terms of previous order. Ld. Counsel for the petitioner has drawn the attention of the Court to application under Order 39 Rule 1 and 2 CPC seeking an interim injunction against further recovery from the pension account of the petitioner. It is argued that already the petitioner has deposited more than 50% of the amount in dispute/the demand of the respondent. It is pointed out that the demand raised by the respondent is Rs.8.07 lakhs approximately and so far an amount of Rs.4.05 lakhs has already been deducted from the account of the petitioner. Ld. Counsel appearing for ESIC submits that he has no objection, if, upon payment of 50% of the disputed/claimed amounts, an injunction is granted, subject to maintaining sufficient balance in the said account by the petitioner. Ld. Counsel appearing for the petitioner undertakes to do the same.
