Sh. Shubhankar Garg, Sub-Staff, Indian Bank is also
present.
Separate statement of Sh. Shubhankar Garg, Sub-Staff,
Indian Bank is recorded, wherein it is stated that a sum of Rs.
4,05,953/- has already been deducted. The recovery sought by the
ESIC is Rs.8,07,369/-, though objected by the applicant.
The attention of the Court is drawn to the application
dated 07.06.2023 under Section 75(2B) read with Section 151 CPC
to waiver of deposit of 50% of the recovery amount of Rs.4,03,685/-
raised by the respondent no.1 vide order dated 11.10.2022 under
Section 45H of the ESI Act.
It is argued that since a sum of Rs.4.05 lakhs has already
been deducted from the account of the applicant, the aforesaid
application be allowed.

Let court notice of this application be served upon the
ESIC, without filing of PF.
Matter be taken up on date already fixed i.e. 21.02.2024.
The application dated 19.12.2023 stands disposed off.
