Present: Ms. Kajal Bhatia, Ld. Counsel for plaintiff (through VC).
Sh. Ashish Khatri, ld. counsel for defendant.
On the last date of hearing, although the summons had been
served on the WhatsApp number on 01.09.2023, however, as a matter of
precaution, plaintiff was directed to take steps for effective service upon the
defendant.
Today, Ld. Counsel for defendant has appeared and filed
Vakalatnama along with written statement and list of documents.
It is submitted that the defendant received the summons
through WhatsApp only 15 days back, however, as per the report the
summons were served with blue ticks on 01.09.2023. In the given
circumstances, the written statement is taken on record subject to a cost of
Rs.1000/ on the defendant payable to opposite side.
Ld. counsel for plaintiff has shared her email id i.e.
legalalsdelhi@gmail.com. Let copy of written statement and documents be
supplied to plaintiff on the said email id.
Matter is adjourned for filing of replication, with advance copy
of the same to opposite party, admission/denial of documents as well as for
framing of issues, on 02.02.2024. Parties are directed to file affidavit of
admission/denial of documents as well as proposed issues on or before the
next date of hearing.
