Matter is at the stage of arguments on application
u/o 6 Rule 17 CPC of the plaintiff and an application u/o 1 Rule
10 r/w Section 151 CPC moved on behalf of proposed
defendants/applicant/Soofia Paiker for her impleadment in the
present case.
Arguments heard on both the applications qua
application u/o 6 Rule 17 CPC. The suit is at the very initial stage
and the amendments sought by the plaintiff through aforesaid
applications are not going to change the nature of the suit.
Accordingly, the aforesaid application u/o 6 Rule 17 CPC of the
plaintiff stands allowed, and the amended plaint filed on behalf
of the plaintiff along with the application is taken on record.
Qua application u/o 1 Rule 10 r/w Section 151 CPC,
it is submitted by Ld. Counsel for the plaintiff that he does not
have any objection if the aforesaid application is allowed because
proposed defendant/Soofia Paiker is claiming herself to be the
owner of the suit property in question. Accordingly, the aforesaid
application u/o 1 Rule 10 r/w Section 151 CPC stands allowed
and applicant/Soofia Paiker is impleaded as defendant no.3 in the
present case.

Plaintiff is at liberty to file the amended plaint in
pursuance to the addition of Ms. Soofia Paiker as defendant no.3
and file the amended plaint along with amended memo of parties
by NDOH with advance copy of the same to the opposite party.
After receipt of amended plaint on behalf of plaintiff, both
defendants are at liberty to file amended/fresh WS to amended
plaint, if any, by NDOH.
Renotify for completion of pleadings/further
proceedings on 31.03.2026.
