admission denial is pressed for. From the pleadings of the parties,
following issues are framed for trial:
1. Whether there exists any unauthorized construction
in suit property i.e. property bearing No. 9169, First
Floor & Second Floor, Gali Nawab Ganj, Azad
Market, Delhi-110006? OPP
2. Whether the plaintiff is entitled to the decree of
permanent injunction as prayed in the plaint? OPP
3. Whether the plaintiff is entitled to the decree of
mandatory injunction as prayed in the plaint? OPP
4. Whether the suit of the plaintiff is barred by the
provisions of Section 477/478 of the DMC Act for
want of statutory notice? OPD-1
5. Relief.
No other issue either arises or is pressed for. List of
witnesses be filed within 15 days from today. The plaintiff is
directed to supply advance copy of affidavits to the opposite
party at least 7 days prior to the next date of hearing.
