Fresh suit received by way of assignment. It be checked
and registered.
Present : Plaintiff with Ld. counsel Sh. Sahib Rajput.
Submissions heard. Record perused.
In view of the submissions of Ld. Counsel for the
plaintiff, defendant no.2 is restrained from demolishing the suit
property i.e. 9169, First Floor, Gali Nawab Ganj, Azad Market,
Delhi-110006 till the next date of hearing.
Plaintiff is directed to comply with the provisions of
order 39 Rule 3 CPC within three days and an affidavit of compliance
be filed on the next date of hearing.
Let summons for settlement of issues and notice of
temporary injunction application be issued to the defendants on filing
PF/RC/electronic modes returnable for 27.05.2025. The plaintiff shall
file copies of plaint and documents along with coloured photographs
and site plan, if any to be sent with the summons. MCD is directed to
inspect the suit property and file status report on the next date of
hearing along with measurements, site plan and coloured photographs.
In the status report, MCD is directed to mention the complete details
of the present construction in the suit property. Copy of order be sent
along with the summons. Steps be taken within 7 days from today.
Defendant should file his written statement of defence within 30 days
from the date of service/receipt of summons. A noting to this effect be
made on the summons.
Copy of this order be given dasti, as prayed for.
