Memo of appearance filed on behalf of defendant no.3.
In between dates, written statement alongwith application u/s 5
of Limitation Act, application under Order 8 Rule 1A CPC and written
arguments alongwith certain annexures filed on behalf of defendant no.2.
Ld counsel for plaintiff submits that he has only received the
copy of written statement and the remaining documents have not been
received by him.
Defendant no.2 undertakes to supply the remaining documents to
Ld counsel for plaintiff today itself.
Upon receipt, the plaintiff is directed to file reply to the aforesaid
applications on or before the NDOH with advance copy to defendant no.2.
At this stage, it is pointed by defendant no.2 that on 06.06.2025,
replication was filed by the plaintiff to the written statement of defendant no.1
/ MCD and due to typographical error, the same was mentioned as defendant
no.2 instead of defendant no.1. The same is acknowledged by Ld counsel for
plaintiff.

In view of the submissions, the order dated 06.06.2025 stands
rectified to that extent.
Put up for arguments on the aforesaid applications as well as
application under Order 8 Rule 1 CPC of defendant no.3, on 21.11.2025.
Date is given at the convenience of all the parties.
Interim Orders to continue till the NDOH.
