Defendant no. 2 in person.
At this stage, Ld counsel for plaintiff submits that despite repeated
opportunities, defendant no. 2 has not filed the written statement in accordance
with law as there is no verification clause in the latest written statement filed by
defendant no. 2. It is further submitted that the defendant no. 2 does not deserve
any further opportunities as he is deliberately delaying the matter. It is further
submitted that right of defendant no. 2 to file written statement be closed.
Defendant no. 2 submits that he does not have legal knowledge and
was not aware of the relevant provision of the law for filing of proper written
statement.
This court has again impressed upon defendant no. 2 to engage a
legal counsel for himself for which he has refused. It is prayed by defendant no.
2 to grant him one last opportunity to file written statement as per law.
Perusal of record shows that the defendant no. 2 has not filed the
written statement as per law despite repeated opportunities which has resulted in
wastage of precious judicial time. Even today, considerable time has been taken
in the proceedings. In the interest of justice and considering the fact that
defendant no. 2 is senior citizen, last and final opportunity is granted to

defendant no. 2 to file written statement in accordance with law within 20 days
with advance copy to the plaintiff.
Interim orders be continued till NODH.
