Present: Sh. M. Shakeel Saifi, Counsel for DH (through VC)
Nazir report received. As per nazir report, certified copy of the site plan has
been filed on 17.07.2025.
Further, as per nazir report, RC Rev. No. 374/2024 is pending in the present
matter but no order of stay has been received.
As per nazir report, the next date of hearing before the Hon’ble High Court
of Delhi was 30.07.2025 as per the last order.
Hence, query is made to counsel for the DH.
Counsel for DH submits at bar that there is no stay in the present matter. He
further states that on 30.07.2025, the other party did not appear before the Hon’ble High
Court of Delhi and therefore, the matter was adjourned for 30.10.2025. He states that no
stay has been granted.
Counsel for decree holder prays that warrants of possession be issued in
respect of tenanted premises with permission to break open the lock and doors and police
aid as per notification no. 99/Rules/DHC dated 15.03.2010 of Hon’ble High Court of
Delhi. He submits that there is no stay on the operation of the order of which execution is
sought.
Argument are heard and record is perused.
On filing of PF and affidavit, issue warrants of possession for execution of
the eviction order.
In case the bailiff finds resistance in execution of the eviction order, he is at
liberty to take assistance of the police. The SHO of the concerned Police Station is directed
to render all assistance in execution of the warrants. In case the premises is found locked,
the lock be broken and the articles found be released on Superdari to the judgment debtor
after an inventory is drawn. Copy of the inventory shall be filed with the report.
To come up before the Ld. ACJ on 22.09.2025 and before this court on
18.10.2025. Copy of this order be sent to the concerned SHO.
