Present : Ms. Shubhi Singh, Ld. Counsel for the plaintiff.
This is a fresh suit for permanent and mandatory
injunction.
Issue summons of the suit alongwith notice of
application under Order 39 Rule 1 and 2 CPC to all the defendants
through all modes on filing of PF/RC, returnable for NDOH.
Let summons be also served by way of electronic
mode. Plaintiff is directed to file an affidavit verifying the
authenticity of email address/Whatsapp number of the defendant.
Process be also given dasti, as prayed.
At this stage, it is prayed by Ld. Counsel for the
plaintiff that ad-interim injunction be granted in favour of the
plaintiff.
Perusal of the application shows that the plaintiff has
sought the same relief as the relief in the suit. Further, in the
considered opinion of this court for proper adjudication of the
application it is essential that the defendant be first served with the
notice of the application and files a reply to the same. Accordingly,
today interim order is not passed. However, in view of the
submissions made by Ld. Counsel for the plaintiff a short date is
being given.
List the matter for 29.03.2025.
