Fresh suit received by way of assignment via e-filing. It be checked and
registered.
Present : Ms. Meenakshi Agarwal, ld. counsel for the plaintiff with
plaintiff
Submissions heard.
Plaintiff is directed to file amended memo of parties as MCD
has not been properly impleaded.
Thereafter summons for settlement of issues and notice of
temporary injunction application be issued to the defendants on filing PF
and RC returnable on 11.04.2023. The plaintiff shall file copies of plaint
and documents along with coloured photographs and site plan, if any to be
sent with the summons. MCD is directed to inspect the suit property within
three days after receipt of summons and file status report on the next date
of hearing along with measurements, site plan and coloured photographs.
In the status report, MCD is directed to mention the complete details of the
present construction in the suit property. Copy of order be sent along with
the summons. Steps be taken within 3 days from today. Defendant should
file his written statement of defence within 30 days from the date of
service/receipt of summons. A noting to this effect be made on the
summons.
