7. Printout of net extract of proof of delivery of legal
notice Ex. PW1/19.
8. Certificate u/s 65B of IEA is Ex. PW1/20.
5. Thereafter, vide separate statement of the plaintiff, PE was
closed on 29.08.2024.
6. I have heard the ex-parte arguments on behalf of the plaintiff
and have also perused the record carefully.
Findings:
7. In support of his case, PW-1 tendered his evidence as per the
pleadings. The plaintiff has relied upon Ex. PW1/1 to Ex. PW1/9,
i.e., the invoices which show that there was commercial transaction
between the plaintiff and the defendant. The plaintiff has relied upon
original cheques Ex. PW1/11 to Ex. PW1/13 and return memo Ex.
PW1/14 to Ex. PW1/16 which shows that the payment attempted to
be made by the plaintiff failed. Further, the plaintiff has relied upon
statement of account Ex. PW1/10 which shows that dues are
pending against the defendant.
8. All the averments made by the plaintiff stand duly proved by
way of the afore-stated documents. Hence, the plaintiff has duly
discharged his burden of proof under section 101 of the Indian
Evidence Act, 1872. It was for the defendant to prove that there was

no liability or amount due against him. It was for the defendant to
dispute the contractual relationship with the plaintiff or to dispute
the genuineness and correctness of the documents relied upon by the
plaintiff or to establish that the outstanding amount claimed or part
thereof has already been paid to the plaintiff or to prove that the
goods were not delivered. However, the defendant has failed to do
so. Despite service of summons, the defendant did not appear and
contest the matter and therefore, was proceeded exparte. Since the
defendant was proceeded exparte and no evidence was led by the
defendant, there is nothing on record which casts any doubt on the
testimony of PW1. The testimony of the PW1 has gone
unchallenged, uncontroverted, and unrebutted. Accordingly, the
plaintiff has successfully proved its case on a scale of balance of
probabilities. There is nothing on record which casts any doubt on
the testimony of PW1.
9. Hence, the plaintiff has duly discharged the burden of proof
under section 101 of the Indian Evidence Act, 1872. Accordingly,
the plaintiff has successfully proved its case on a scale of balance of
probabilities.
Interest
10. The plaintiff has instituted the present suit for principal
amount of Rs. 1,83,986/-. The plaintiff has claimed an interest of
18% p.a. on the principal amount from 27.05.2022 to 27.01.24. The

plaintiff has not proved as to how it was agreed between the parties
that interest of 18% will be applicable. Further, the plaintiff has
claimed the amount of Rs. 1,83,986/- as shown in the statement of
accounts. Accordingly, this Court does not deem fit to award interest
of 18% p.a., from 27.05.2022 to 27.01.2024 amounting to
Rs.55,196/-. Further, the plaintiff has claimed interest at the rate of
18 % per annum on the decreetal amount. Considering the
prevailing market conditions, it is not considered equitable to grant
this high rate of interest. Accordingly, simple interest at the rate of
6% per annum is considered reasonable and equitable.
Relief:
11. In view of the above discussion, the suit of the plaintiff is de-
creed and the following relief is being given to the plaintiff: -
(a) A decree of Rs. 1,83,986/- is being passed in favour of
the plaintiff and against the defendant, alongwith simple
interest @ 6% p.a. from the date of filing of suit till date of
realization of the decreetal amount.
(b) Costs of the suit are also awarded in the favour of
the plaintiff and against the defendant.
12. Decree sheet be prepared accordingly.
