Sh. Manoj Gautam, Ld. counsel for defendant.
Ld. counsel for defendant states that entire set of
plaint as well as documents had been received and seeks time to
file WS within statutory period. Considered.
WS be filed within statutory period alongwith
advance copy to the opposite side atleast 07 days before the next
date.
Ld. counsel for plaintiff states that prayer in the
application U/O 39 Rule 1 and 2 CPC be allowed till the next
date and thereafter, the application be decided on merits. He
prays that defendant be directed to not interfere in the possession
of the plaintiff in the suit property.
Ld. counsel for defendant upon instructions states
that without prejudice to the rights and contentions on the merits
of the case and without admitting the case of the plaintiff, the
defendant shall not interfere in the possession of the plaintiff in
the suit property till the NDOH.
Considered.
Accordingly, defendant is directed to not interfere in
the possession of the plaintiff in the suit property till the next date
and contentions of the defendant on the merits of the case are
reserved.
At this juncture, Ld. counsel for the parties state that
there is possibility of settlement and pray that the present matter

be referred to Mediation Cell for 19.04.2025 at 12:30 pm.
Considered.
In view of the submissions made, the present matter
is referred to Mediation Cell for 19.04.2025 at 12:30 pm.
To come up before this court for report on settlement
/further proceedings on 22.05.2025.
At request, copy of the order be given dasti to the
parties.
