and 3 despite repeated calls since morning. Hence, the case is
proceeded ex-parte against them.
Pleadings are complete. Same are perused. No
admission denial is pressed for. From the pleadings of the parties,
following issues are framed for trial:
1. Whether there exists any unauthorized construction
in the suit property i.e. property bearing No.12,
Ground Floor, Azad Market, New Delhi? OPP
2. Whether the plaintiff is entitled to the decree of
permanent injunction as prayed in the plaint? OPP
3. Whether the plaintiff is entitled to the decree of
mandatory injunction as prayed in the plaint? OPP
4. Relief.
No other issue either arises or is pressed for. List of
witnesses be filed within 15 days from today. The plaintiff is directed
to supply advance copy of affidavits to the opposite party at least 7
days prior to the next date of hearing.
Matter be re-listed for Plaintiff Evidence on 07.08.2025.
