Present: Sh. Harish Chand Singh, Ld. counsel for plaintiff.
An application has been filed on behalf of plaintiff under
Order 7 Rule 14 CPC seeking leave to take on record additional documents
as filed along with the application.
Ld. Counsel for plaintiff submits that plaintiff wishes to bring
on record the copy of GPA, agreement to sell, affidavit and receipt pertaining
to the suit property and prays that the said documents as filed along with the
application be taken on record and the application under Order 7 Rule 14 CPC
be allowed. Ld. Counsel for plaintiff further submits that inadvertently the
said documents could not be filed by plaintiff along with the plaint.
Submissions heard. Record perused.
In the interest of justice and considering the fact that the
summons are yet to be issued to defendant, no prejudice would be caused to
defendant if the said application is allowed and if the said additional
documents are taken on record.
Accordingly, the application filed on behalf of plaintiff under
Order 7 Rule 14 CPC is allowed and the said additional documents filed along
with the application are taken on record.
Arguments heard.
Let summons be issued to defendant on filing of PF within 15
days.
Put up for further proceedings on 21.05.2025.
