been filed with a delay of about 75 days. Ld. Counsel for
defendant No.2 has orally prayed for condonation of delay, to
which, Ld. Counsel for the plaintiff has no objection if the delay
is condoned.
Heard. Perused.
In view of no objection given by Ld. Counsel for the
plaintiff and in view of settled position of law that Court shall not
be hypertechnical with the procedural law and endeavor shall be
made to dispose of the cases on merits than to dispose of the case
on the procedural aspects, the delay in filing the WS stands
condoned subject to cost of Rs.1,000/- to be paid to the plaintiff.
Cost paid.
WS is taken on record. Copy supplied.
Replication, if any, be filed on or before the next
date of hearing with advance copy to the opposite side atleast one
week prior to the next date of hearing.
Put up for arguments on application u/o 39 Rule 1 &
2 CPC, filing of replication, completion of pleadings and framing
of issues on 04.08.2025.
Interim order dated 28.04.2025 to continue till the
next date of hearing.
