Today the matter was fixed for filing of replication by
the plaintiff to the WS of the defendant as well as for arguments on
his application filed under Order 39 Rule 1 and 2 CPC.
However, the Ld. Counsel for plaintiff has submitted that
the copy of the WS supplied on the last date of hearing is incomplete
as page no.7, 8, 9 and 10 of the WS are missing from the copy of the
WS supplied by the defendant. It is further submitted by the Ld.
Counsel that since the defendant has also filed on record certain
colour photographs alongwith his WS, the defendant may also be
directed to supply the colour copy of the said photographs to the
plaintiff.
The Ld. Counsel for defendant has submitted that he
would supply the same within 3 days from today.
Accordingly, on receipt of the copy of the same, the
plaintiff would be at liberty to file his replication, if any, by the next
date of hearing with advance copy to the defendant side.
At this stage, a counter claim u/s 6 of the Specific Relief
Act seeking the recovery of the suit property is also filed on behalf of
the defendant. The same is taken on record. Copy of the same also
stands supplied to the plaintiff side. The same be registered separately
as per law.

Ahlmad is directed to make necessary compliance.
Plaintiff is at liberty to file his WS to the counter claim
of the counter claimant/defendant on or before the next date of
hearing with advance copy to the counter claimant/defendant side.
Put up for further proceedings on 10.05.2023 in both the
cases.
