Fresh vakalatnama is filed on behalf of defendants. Same is taken on
record.
It is submitted by the Ld. Counsel for defendants that he has been
recently engaged and summons of the suit were also received by the defendants only
on 04.03.2023, he seeks a short adjournment to file WS on behalf of the defendants as
well as their reply to the application of the plaintiff filed u/o 39 rule 1 & 2 CPC.
At this stage, Ld. Counsel for plaintiff has also submitted that he also
wants to file on record some additional documents and as such the request of Ld.
Counsel for defendant for adjournment is also not opposed.
Considering the abovesaid submissions, matter is adjourned for further
proceedings for 15.04.2023.
Defendants are at liberty to file their WS as well as reply to the
application of the plaintiff u/o 39 rule 1 & 2 CPC on or before the NDOH with
advance copy to the opposite party. On receipt of advance copy of the WS, plaintiff
would also at liberty to file his replication, if any to the WS of the defendant.
