Ld. counsel for the defendant submits that copy of
the plaint and documents were supplied but certain pages are still
illegible.
Ld. counsel for the plaintiff has filed fresh copy of
certain documents in the court. He states that such documents are
those which have been stated to be illegible by Ld. counsel for
the defendants. Let the same be supplied to the defendants / Ld.
counsel against receipt.
Let WS be filed within 30 days from today
alongwith advance copy to the opposite side.
Replication, if any be filed on or before the NDOH,
alongwith advance copy.
Ld. counsel for plaintiff prays that application U/O
39 Rule 1 and 2 CPC be decided.
Ld. counsel for defendant states that she shall only
be able to lead arguments on such application after receiving
copy of the legible pages of the documents annexed with the
plaint.
In view of the submission on behalf of the
defendant, the court deems it fit to defer the matter for arguments
on the application U/O 39 Rule 1 and 2 CPC as legible copies

have not been supplied.
Let reply to the application U/O 39 Rule 1 and 2
CPC, if any, be filed on or before the NDOH alongwith an
advance copy to the opposite side.
Now to come up for arguments on the application
