Present: Mr. Akash, proxy counsel for plaintiff along with
plaintiff’s father.
Mr. Neha Gawra, counsel for defendants along with
defendants through VC.
Record shows that plaintiff has not paid previous
costs till date.
At this stage, plaintiff has paid a cost of Rs.1,000/-
in cash, to the opposite counsel in terms of last order.
It is further undertaken by counsel for plaintiff that
plaintiff will deposit the cost imposed on 06.12.2024 today itself.
Let cost be paid and its receipt be placed on record by 02:00 PM.
Matter is listed for consideration of application
moved by defendant u/o 39 Rule 1 and 2 CPC. Plaintiff has not
filed reply to the said application till date.
It is stated by proxy counsel for plaintiff that
plaintiff does not wish to file reply to this application and this
Court may proceed to frame issues.
It is hereby made clear to plaintiff that issues will
be framed after disposal of this application.
In case, plaintiff does not wish to file reply, this
Court is inclined to hear arguments today.

At this stage, proxy counsel for plaintiff is seeking
an adjournment to address arguments as main counsel is not
available today.
Request for adjournment is disallowed. Matter is
passed over for 11:30 AM.
