Perusal of the file shows that none had appeared on
behalf of the plaintiff on the last two dates. Also, the matter was
listed for ex-parte PE on 09.05.2025 and till date, plaintiff has not

led any evidence. Repeated adjournments was sought on behalf of
the plaintiff for leading evidence.
Perusal of the file shows that vide order dated
26.09.2025, one last and final opportunity was granted to the
plaintiff to pursue the matter, failing which it was directed that the
matter shall be dismissed for non-prosecution. Despite the said
direction, plaintiff has failed to lead evidence.
Even today, none is present on behalf of plaintiff
despite repeated calls made since morning. It appears that the
plaintiff is not interested in pursuing the present matter.
Accordingly, the present suit is dismissed in default
and for non prosecution.
File be consigned to record room after due
compliance.
