plaintiff.
Sh. S.N. Garg, Proxy Counsel for defendant No.1 along
with Sh. Dennis Masih, Legal Retainer.
As per record, application u/s 151 CPC filed by defendant No.2,
another application filed by defendant No.2 u/s 14 Rule 5 CPC for
framing of additional issue on 09.12.2023.
Reply filed on behalf of plaintiff to the applications filed.
At this stage, the plaintiff submits that he has applied for new
electricity connection by applying online in the capacity of owner.
Whereas he is claiming himself to be the co-tenant. He further submits
that he will apply for new electricity in the capacity of co-tenant.
At this stage, plaintiff seeks liberty of the Court to withdraw the
present suit due to technical defects with liberty to file it afresh.
Since considerable amount of time has been wasted by the
defendant in contesting the present suit which was filed on 16.02.2023.
Accordingly, liberty is granted to the plaintiff to withdraw the present
suit subject to cost of Rs.1000/- each to be paid to both the defendants.
Cost paid.
Separate statement of plaintiff is recorded to this effect.
In view of separate statement of plaintiff, the present suit is
disposed off as withdrawn with liberty to plaintiff to file it afresh.
File be consigned to the record room after due compliance.
