Present : Ld. Counsel for DH.
As per the nazir report, there is no stay on the
execution of the eviction order dated 07.10.2023 and six months
of time for vacation of the suit premises has already lapsed. Ld.
Counsel for the DH has prayed for issuance of warrants of
possession against the JD stating that the possession of the suit
premises has not been received by the DH till date.
Argument are heard and record is perused.
On filing of PF, issue warrants of possession for
execution of the eviction order.
In case the bailiff finds resistance in execution of the
eviction order, he is at liberty to take assistance of the police. The
SHO of the concerned Police Station is directed to render all
assistance in execution of the warrants. In case the premises is found
locked, the lock be broken and the articles found be released on
Superdari to the judgment debtor after an inventory is drawn. Copy of
the inventory shall be filed with the report.
To come up before the Ld. ACJ on 05.04.2024 and
before this court on 25.05.2024. Copy of this order be sent to the
concerned SHO for intimation and necessary compliance.
