Sh. Vaibhav Yadav, Ld. Counsel for defendant along
with Sh. Ajit Kundra, Supervisor, BSES, Chandni
Chowk Division.
Process received back duly served on the defendant.
Time is sought by the defendant to file the WS.
It is stated in the plaint that in the month of
December 2016, Suresh Dubey and his wife Santoshi forcefully
cut off the connection of electricity of plaintiff. It is further stated
that defendant/BSES is seeking no objection from Suresh Dubey
and his wife Santoshi for installation of new electricity
connection as the said persons obstructed to the installation of
new electricity connection.
Ld. Counsel for plaintiff submits that the aforesaid
persons are co-occupants of the suit property who have intention
to dispossess the plaintniff.
In the considered view of this Court, Suresh Dubey
and his wife Santoshi are necessary party for proper adjudication
of the present suit and therefore, they are impleaded as party to
the present suit in terms of Order 1 Rule 10(2) of CPC.
Let summons be issued to Suresh Dubey and his
wife Santoshi subject to filing of amended memo of parties on
filing of PF/RC including electronic modes.
Put up on 03.05.2025.
Date is given as per convenience of counsels.
