File taken up on an urgent applicantion filed on behalf of objector namely
Sh. Satya Pal Vaish appearing through his counsel.
Present :- Sh. V.N. Chaturvedi, Ld. Counsel for objector/applicant.
Present is an application filed on behalf of objector namely Sh.
Satyapal Vaish seeking stay upon warrants of possession issued vide order
dated 24.01.2026.
It is submitted by Ld. Counsel for applicant that present
execution proceedings were stayed by the Ld. RCT vide order dated
15.12.2025. Further submitted that applicant has complied with directions
given by the Ld. Appellate Court vide order dated 15.12.2025. It is argued
by Ld. Counsel for applicant that the applicant/objector was directed to
deposit sum of Rs.15000/- per month form the date of eviction order.
Further argued that in the present facts and circumstances the eviction order
as mentioned by the Ld. Appellate Court be supposed to mean order dated
12.11.2025 by which objections of objector/applicant herein were dismissed
by this Court and warrants of possession were issued against the JD. The
Ld. Counsel for applicant requested that time be given to get clarification
form the Ld. Appellate Court. Prayed that warrants of possession be stayed
till then.
Let notice of the present application be issued to the opposite
party on filing of PF.
In the interest of justice, meanwhile, warrants of possession
directed to be issued vide order dated 24.01.2026 shall remain stayed till the
NDOH.

Nazir of the court is directed to immediately inform the bailiff,
if appointed already.
Meanwhile, objector is at liberty to get clarification from the
Ld. Appellate court regarding the above mentioned argument, failing which
the present executing court shall proceed in accordance with law.
It is submitted that the Ld. Counsel for applicant that the next
date of hearing before the Ld. Appellate Court/ Ld. RCT is 23.03.2026.
Put up for further proceedings on 27.03.2026.
At request, Dasti order be provided to the applicant.
