Application is under consideration filed on behalf of
Satya Pal Vaish u/o 41 Rule 5 (2) CPC for grant of stay on the
present execution proceedings and u/s 151 CPC for grant of
exparte interim stay on process of execution proceedings till the
adjudication of review petition vide petition no Misc RC NO.
40/2023 titled as “Satya Pal Vaish Vs. Amna Khatoon and ors.
Heard on the application. Record perused.
It is pertinent to mention that vide even dated order.
The application of applicant seeking review has been dismissed
“Misc RC NO. 40/2023 titled as “Satya Pal Vaish Vs. Amna
Khatoon and ors”
In view thereof, the abovesaid application for grant
of stay on the execution proceedings and u/s 151 CPC for grant
of exparte interim stay also stands dismissed.
Issue fresh warrants of possession against the JD and
in favour of the DH, in respect of property bearing no. 2167,
measuring about 180 sq. yards situated at main road, phatak
Habas Khan, Gali Hinga, Baig, Delhi-110006 as per the site plan
mark A subject to filing of PF. Further, Bailiff is directed to
remove all hurdles including lock, doors etc. in order to execute
present warrants of possession Further, Bailiff is directed to take
all other necessary auxiliary steps for execution of present
warrants of possession. DH shall file an affidavit to the effect

that there is no stay or appeal pending on the execution of the
eviction order. Concerned SHO is directed to provide police aid
and assistance including lady police officer, if required, to the
Bailiff for execution of warrant of possession.
DH is directed to appear before Ld. ACJ for
appointment of Bailiff on 13.09.2024 and for report on
05.10.2024.
