Wife of defendant in person.
On perusal of order sheets, it is revealed that the
defendant was served with summons on 20.05.25 and more than
eight months have lapsed, but till date the WS has not been filed.
In these circumstances, the right of defendant to file WS is
hereby closed.
Now, put up for further proceedings on 07.02.2026.

At this stage, Mr. B. Khan, Ld. Counsel for defendant has
appeared and submitted that the WS has already been filed online
on 24.11.25. Hard copy filed today. Copy of plaintiff retained on
record, which he is at liberty to obtain against due receipt.
It is further submitted that the hard copy of the WS
was not filed as application u/o VII Rule 11 CPC was pending.
Orders passed in the morning are hereby recalled.
Let replication, if any, be filed on the NDOH with
advance copy to opposite side against receipt.
Let affidavit of admission/denial of documents be
also filed by both parties and proposed issues, if any, on NDOH.
List for completion of pleadings / filing of affidavit
of admission/denial of documents / settlement of issues on date
already fixed i.e. 07.02.2026.
