Present: None.
Perusal of record shows that notice issued to the respondent was received
back with the remarks that the respondent has already expired. The said report is dated
08.04.2025. Perusal of report shows that the daughter in law of the deceased respondent
had informed the same.
Therefore, prima facie, the death of the respondent occurred on 08.04.2025
or prior to that.
The prescribed period of 90 days has already expired. However, no steps
have been taken on behalf of the petitioner to implead the LRs of the respondent.
Therefore, on the lapse of 90 days, the matter stands abated as per order 22 Rule 4 (3) CPC.
Furthermore, none has appeared on behalf of the petitioner. Even on the last
date of hearing, none had appeared on behalf of the petitioner. Therefore, the matter is also
liable to be dismissed under Order 9 Rule 2 CPC and under Order 9 Rule 3 CPC for non-
appearance and non-prosecution as well.
Accordingly, matter stands disposed off.
