Present: Ms. Shefali Gandhi, Ld. counsel for DH.
Physical copy of execution petition alongwith
documents has been filed. Same is taken on record.
Ld. counsel for the DH states that the movable and
immovable properties of the JD qua which the execution petition,
falls within the jurisdiction of Gurugram, Haryana and prays that
the present execution petition be transferred to District Court,
Gurugram, Haryana and transfer certificate be issued.
Heard.
As per submissions, the movable and immovable
properties of the JD qua which the execution is pending falls
outside the territorial jurisdiction of this court. Therefore, the
request for transfer is allowed and transfer certificate be issued to
District Court, Gurugram, Haryana. Copy of Transfer Certificate
be given dasti as per rules upon furnishing certified copy of the
entire petition and documents.
File be consigned to Record Room after due
compliance.
