Order Details: COPY OF JUDICIAL PROCEEDINGS
Pdf Text: 10 RC ARC 36/25
BUSHRA FAISAL Vs. RADHEY SHYAM
11.07.2026
Present: Mr. M.U. Rehman, Ld. Counsel for the petitioner along-with
petitioner.
Mr. Sunil Gupta, Ld. Counsel for the respondent.
An application u/o 7 Rule 14 CPC has been filed by the petitioner
to place on record the Class 10th CBSE mark-sheet and certificate on record.
The same have been filed to establish the parentage of the petitioner.
The said application is vehemently opposed by Ld. Counsel for the
respondent on the ground that the orders on leave to defend application were
already reserved and the present application has been filed at an extremely
belated stage. He has further submitted that the surname of the person
mentioned in the aforesaid documents is different from the surname of the
petitioner.
File perused.
The general rule is that in a petition u/s 14 (1)(e) of the DRC Act,
there is no stage to file additional documents unless the same pertains to a
subsequent event. However, the documents sought to be placed on record
pertain to a public record and hence, there is no impediment in taking the same
on record.
Accordingly, the present application stands allowed and the Class
10th CBSE mark-sheet and certificate are hereby taken on record, subject to the
petitioner filing an affidavit in this regard within 15 days with advance copy to
the opposite party.
The respondent is at liberty to file a counter-affidavit, within a
period of 15 days thereafter with advance copy to the opposite party.
Put up for further proceedings on 15.09.2026.
