Matter received back from Mediation Centre as not settled.
Perusal of the record denotes that written statement along
with an application u/s 5 of Limitation Act for condonation of delay in
filing the written statement was filed on behalf of defendant on
26.09.2023.
Ld. Counsel for plaintiff submits that he has no objection if
the said application is allowed and the written statement filed by
defendant is taken on record subject to cost.
In view of the above and in the interest of justice and
keeping in view the settled principle of law that procedure should be
used to subserve and advance the cause of justice, the application under
Section 5 of Limitation Act filed on behalf of defendant for condonation
of delay in filing written statement is allowed subject to cost of Rs.
1000/- to be paid by defendant to the plaintiff.
Accordingly, written statement filed by defendant is taken
on record.
List of documents along with certain documents has been
filed on behalf of defendant today. Copy supplied.

Ld. Counsel for the plaintiff submits that he has no
objection if the said documents filed by the defendant are taken on
record.
In view of the same and in the interest of justice, the
documents filed on behalf of defendant today are taken on record.
Ld. Counsel for the plaintiff seeks time to file replication to
the written statement filed on behalf of defendant.
Replication, if any, be filed within 15 days with advance
copy to the opposite party.
Put up for admission/denial of documents and framing of
issues on 02.02.2024.
