Misc SCJ 17/25
DR HARVINDER SINGH Vs. PRABHGUN KAUR through her maternal Grand
Mother SMT MANJEET KAUR SAHNI
08.01.2026
Present : Mr. Maninder Madhok, Ld. Counsel for review applicant / original
respondent no.2.
This is an application filed under Section 114 CPC seeking review of the
impugned judgment dated 05.09.2024 in SC No. 29/28 titled as ‘Prabhgun Kaur and Anr.
Vs. State and Anr.’. Vide such judgment, succession certificate was issued in favour of the
petitioner no.1 Ms. Prabhgun Kaur (minor). It is the case of the applicant that the court,
while passing the judgment, has ignored the fact that there was a settlement in such case
before the mediation centre and the same was not referred to in the impugned judgment.
It is further stated that certain securities which were part of the judgment were not taken
into account in the judgment. It is also the case of the applicant that the petitioner no.2 has
not honoured the settlement which took place between the parties before mediation centre.
Application has been perused and arguments have been heard.
In the opinion of this court, no grounds for review of the judgment dated
05.09.2024 are made out at all from the perusal of the present application. There is neither
any error apparent on the face of record nor any fact which has been brought to light in
the application which calls for re-opening the case. Furthermore, merely because the other
side has not honoured the settlement between the parties, does not call for review of the
judgment in question.
Para 13 of the judgment clearly shows that applicant/respondent no.2 had
given his no objection in favour of his daughter i.e. petitioner no.1, on the basis of which
the judgment came to be passed in favour of petitioner no.1.
-- 1 of 2 --
The applicant is at liberty to avail his other remedies available to him under
the law for non-compliance of the settlement between the parties by petitioner no.2.
Accordingly, the present application is dismissed and disposed off.
File be consigned to Record Room after due compliance.
