The court is functioning in both physical and virtual modes.
All the Counsels appearing through VC are requested to keep their
video on, appear in proper Court attire and join from a disturbance
free location.
Present: Sh. Surender Tyagi, Ld. Counsel for plaintiff through VC.
Today, an application has been filed by the plaintiff under
Section 151 CPC seeking appropriate directions for effecting service of
summons upon the defendant. It is stated that the defendant, namely M/s
Celestial LED Light Pvt. Ltd., is also a party in CS SCJ/56/2024, titled
M/s Om Sai Technosys Vs. M/s Celestial LED Light Private Ltd. & Ors.,
pending before the concerned Court at Rohini Courts, Delhi, wherein the
defendant is regularly appearing and the matter is fixed for defendant’s
evidence on 12.10.2026.
The plaintiff has accordingly sought permission for
facilitating service upon the defendant during its appearance in the said
proceedings, with the object of ensuring expeditious and effective service
and avoiding further delay in the present proceedings.
In view of the facts and circumstances, the application is
allowed.
Let summons be issued to the defendant through ordinary
mode at the address furnished on record.
The Process Server is further directed that, in case the
defendant or its authorised representative is found appearing in the
proceedings titled M/s Om Sai Technosys Vs. M/s Celestial LED Light
Private Ltd. & Ors., CS SCJ/56/2024, pending before the concerned
Court at Rohini Courts, Delhi, the summons issued in the present matter

shall also be effected upon the defendant or its authorised representative
after obtaining due permission of the concerned Court.
Process Server shall file his report regarding service on the
next date of hearing.
Application stands disposed of accordingly.
Put up for filing of report/appearance of defendant/further
proceedings on 23.09.2026.
