Present: Sh. Amar Saini, Ld. Counsel for applicant (through VC).
None for respondent.
This is an application moved on behalf of complainant u/s 431 Cr. PC
r/w section 421 Cr. PC for recovery of the amount. Same is considered.
Parchayadast along-with last ordersheet has been filed by Ahlmad of
this court stating that file is not traceable. Ahlmad is directed to trace the file till
NDOH.
This is the 2nd time that Parcha has been filed. Ahlmad is given last
opportunity to trace out the file.
On LDOH, BWs were ordered to be issued against the accused/respondent.
Same has not been issued.
Let fresh bailable warrants in the sum of Rs. 10,000, be issued
against the accused/respondent, with one surety of like amount, through the SHO
concerned, on filing of PF within two months, returnable on NDOH.
Warrants
should carry an endorsement that accused/respondent is
given an opportunity to make the payment of the requisite amount.
Ld. Counsel for complainant/applicant submits that some amount has
been received. However, he needs time to verify the pending amount for recovery.
Ld. Counsel for complainant is also directed to file the list of movable
and immovable properties in the name of respondent.
Put up for further proceddings on 27.02.2026.
