Matter is at the stage of furnishing of bail bonds by the accused and
framing of notice.
Fresh Vakalatnama filed on behalf of the accused. Taken on record.
Bail bonds furnished on behalf of the accused. Same are hereby
accepted.
Notice under Section 251 Cr.P.C. has been framed upon the
accused. His plea of defence has been recorded. Accused has pleaded not guilty
and claimed trial. He has pressed for cross-examination of complainant/AR under
Section 145(2) NI Act.
In view of plea of defence of accused, probable defence has been
raised and accused is granted opportunity to cross-examine the complainant/AR.
Considering the circumstances, the present matter is being tried as a summons
case instead of summarily, in terms of second proviso to Section 143(1) NI Act.
In terms of admission/denial of the documents recorded under
Section 294 Cr.P.C., witnesses at sr. no. 2 and 3 are hereby dropped from list of
witnesses.
