Proposed accused no.1 is a Parnerhsip firm through Subhash, Partner.
Proposed accused no. 2, Aruna, Partner is absent.
Proposed accused no. 3, Itin, Partner is absent.
None for the proposed accused.
Matter is at the stage of consideration.
Perusal of record shows that proposed accused Subhash is the
signatory to the cheque in question.
No specific averments are alleged in the complainant qua proposed
accused no. 2 & 3 in terms of section 141 of NI Act.
Accordingly, the court does not deem it fit to initiate proceedings qua
accused no. 2 and 3.
Matter is at the stage of consideration.
Case file perused.
Let notice as per section 223 BNSS, be issued to the proposed accused
partnership firm Dutta Industrial through its Partner Subhash Chander, on filing of PF
within two months, returnable on NDOH.
Further, the complainant is at liberty to serve the copy of this order to the
proposed accused as notice through whatsapp, SMS, e-mail subject to the filing of affidavit
of service on e-mail or mobile number of proposed accused.
Complainant is directed to file proof of service.
Put up for arguments on summoning/consideration on 31.01.2026.
