Accordingly, issue fresh notice of the application of condonation of
delay to proposed accused no. 2, through all modes on filing of PF within two
months returnable on NDOH.
Copy of application be also filed at the time of filing of PF to be sent
along with the notice.
Complainant is directed to supply the soft copy of application of
condonation, complaint and documents to the proposed accused well in time.

Perusal shows that the cheque in question is drawn on the personal
account of one of the proposed accused. Complainant submits that cheque has been
drawn in the name of proposed accused no. 2 Salvarani S only.
Complainant is directed to file the requisite loan agreement by NDOH.
Since, complaint u/s 138 NI Act is maintainable only qua drawer of
cheque in question, accordingly, issue notice of condonation of delay to proposed
accused no. 2 Salvarani S only, through all modes on filing of PF within 2 months
returnable on NDOH.
