Let notice be issued to the IO / HC Vipin Kumar for compliance of the same. At this stage, accused submits that he does not have means to engage a private counsel and seeks legal aid counsel. Sh. Darshnik Narang, Ld. LADC attached with this court. He is assigned and directed to complete formalities for being appointed as legal aid counsel. Ld. Counsel for the accused has submitted the compliance u/s 230 BNSS has been made. Arguments heard on the point of notice. It is submitted by Ld. Counsel for accused that accused has been falsely implicated in the present case. Ld. APP for the State submits that there is enough evidence on record to carve out a prima facie case against the accused Heard. Perused and considered. On going through entire record, prima facie offence u/s 304(2) BNS is made out against the accused. Hence, charge u/s 304(2) BNS is framed against the accused to which he pleaded not guilty and claimed trial. Witnesses at serial no. 1 and 2 in the list of witnesses be summoned alongwith MHCM for the next date of hearing. Put up for PE on 19.02.2025. Rehnumai through VC on every 14 days.
