Counsel for the complainant alongwith complainant. Sh.Kaushal Kishore Bharti, Ld. Counsel for the proposed accused alongwith proposed accused. These are two connected matters. Ld. Counsel for the proposed accused submits that the present application has been filed without mentioning the relevant section number. He further submits that the amendment sought by the complainant is not clerical in nature but alters the nature of the case and therefore, the amendment sought by the complainant ought not to be allowed. Lastly, he submits that the legal demand notice stands invalidated owing to the demand of Rs.8,30,000/- as per para no.2 and 3 but the different demand is made in the prayer clause of the legal demand notice. Ld. Counsel for the complainant submits that the amendment sought is clerical in nature as stated in para no.4 of the application. He further submits that para no. 2 and 3 does not relate to the demand from the accused but is the total outstanding pending against the accused and his prayer clause be relied in this regard. In support, Judgment tiled S.R. Sukumar Vs. S.Sunaad Raghuram SC relied, seen and returned back. Accused is granted the liberty to file citation, if any, with advanced copy to the opposite side.
