Present: Sh. Vikas Kumar, AR of complainant in person.
None for accused.
An application has been filed for substitution of AR by the
complainant. Same is taken on record. Application being formal in nature is
allowed and accordingly Mr. Vikas Kumar stands substituted as AR of the
complainant.
AR for complainant seeks time to file his fresh evidence affidavit.
Copy be sent to opposite side atleast 7 days prior to NDOH.
Original postal receipts and tracking report on summons filed on
behalf of complainant with the report ‘item delivered’. Taken on record.
None has appeared on behalf of accused despite service.
Let bailable warrants in the sum of Rs. 10,000/-, be issued against the
accused, with one surety of like amount, through the SHO concerned, on filing of PF
within 2 months, returnable on NDOH.
Complainant is directed to supply the soft copy of complaint and
documents to the accused well in time.
Warrants should carry an endorsement that accused is at liberty to
settle the matter and pay the amount to the complainant by reaching out the
complainant on the no. 8459362746, in view of the judgment passed by Hon’ble
Supreme Court of India, in case titled as
Sanjabij Tari Vs. Kishore S. Borcar & Anr.,
