Accused is absent.
None for accused.
NBWs issued against the accused through received back unexecuted
with the report that wife of accused Ms. Rachna was found who stated that accused
is not at home and she shall inform him about NDOH. Accused was contacted on his
phone who undertook to appear on NDOH.
Complainant submits that for 3 connected matters bearing CC NI ACT
13340/2024, 13342/2024 and 13343/2024 for a total amount of Rs. 3,50,000/-,
accused has paid only Rs. 1,00,000/- on 16.04.2026.
Previously BWs received back executed.
Accordingly, it is inferred that accused is deliberately avoiding
appearance before this court.
Let NBWs be issued against the accused through the concerned DCP
returnable on NDOH, on filing of PF within two months. DCP concerned is directed
to ensure atleast three visits/ attempts are made to execute the process and proper
report be filed.
Copy of this order be sent to DCP concerned to ensure compliance.
Complainant is directed to supply the soft copy of complaint and
documents to the accused well in time.
Put up for appearance of accused/ framing of notice/ furnishing of
surety/ further proceedings on 01.10.2026.
