Matter is listed at pre-cognizance proceedings. However, as per
judgement of Hon’ble Supreme Court in
Sanjabij Tari Vs. Kishore S. Borcar and Anr.
(2025 INSC 1158) , the accused is not required to be heard through a notice at the pre-
cognizance stage.
Perusal of record reveals that the present is a transferred filed from the
Digitatl Court.
Two clarification are required from the complainant. Firstly, the
maintainability of the complaint qua proposed accused No.2, in the light of the fact
that the cheque in question appears to have been drawn on the personal account of
proposed accused No.1. Secondly, the date of filing the complaint is not clear and no
record is annexed for the same. Time is sought to clarify the same.
List the matter for clarifying and filing the abovesaid on 03.11.2026.
